Terms of engagement

These terms apply when you ask Utility Garden to carry out a Retention Study, cohort reading session, lapsed-user interviews, or return-path review. By sending a note through this site or signing a letter of engagement, you accept them. If a signed letter conflicts with this page, the letter wins for that engagement.

The work

We provide professional study and workshop services as described on this site and in the letter. We do not sell software, hosted reporting, or a licence to our methods. Dates are estimates until both sides have confirmed data access.

Your materials

Event exports, lapsed lists, and test accounts remain yours. You confirm you have the right to share them and that interview contacts have consented. We use those materials only to perform the engagement.

Our materials

The written brief, marked-up tables, and workshop slides are licensed to you for internal use, including sharing with staff and contractors bound to confidentiality. You may not resell the brief or present it as your own published research. We retain the right to reuse anonymised working methods.

Confidentiality

We do not publish your figures. We may describe the industry and city in general terms (for example, “a grocery app in the Klang Valley”) unless the letter forbids even that.

Liability

We are not your product team. Decisions you take after a workshop are yours. Our liability for an engagement is limited to the fees paid for that engagement, except where Malaysian law does not allow a limit (including death or personal injury caused by negligence, and fraud).

Governing law

These terms are governed by the laws of Malaysia. Courts in Kuala Lumpur have exclusive jurisdiction, unless a letter of engagement names another Malaysian forum.
